Legal team appeals ruling on Charter challenge
Former Lanark-Frontenac-Kingston MPP Randy Hillier’s legal team appealed a ruling on his Charter challenge against the Reopening Ontario Act last week.
Hillier was charged in 2021 for participating in anti-lockdown rallies in Cornwall and Kemptville.
His lawyers argued before the Ontario Court of Appeal that the act’s restrictions on gatherings during the COVID-19 lockdown violated his right to peaceful assembly under the Charter.
They claimed the judge in the original ruling misapplied legal tests and failed to properly consider the impact of a complete ban on gatherings.
The court will issue its decision at a later date.
